Clause 9 of the provisions of the LR CM on distance contracts states that the Consumer* has the right to withdraw from the contract within 14 calendar days and return the product to the seller. However, at the same time, it should be taken into account that Regulation No. 207 “Rules on Distance Contracts” Clause 14.1 states: “The consumer, using the right of refusal mentioned in these regulations, is responsible for any kind of decrease in the value of the product, if the product has been used in a way that is incompatible with the principle of good faith, including used for another purpose, not to ascertain the product’s characteristics or performance”.
Therefore, please take into account that during the period of exercising the right of refusal, the consumer has the right to use the product as far as it is necessary to test the product. By using the right of withdrawal, the consumer is responsible for the use of the product that exceeds the intended purpose of testing the product, for the use of the product within the period of use of the right of withdrawal, which is incompatible with the principle of good faith, as well as for the decrease in the value, quality and safety of the product.
www.ciirulis.com asks the consumer to keep the packaging of the purchased product until the expiration of the right of withdrawal, and in cases where the right of withdrawal is used, the product must be returned in undamaged or the same way packaging.
www.ciirulis.com informs that based on the sixth part of Article 12 of the Law on the Protection of Consumer Rights, the consumer is responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal.
If it is established that the consumer has damaged or worsened the condition of the product and thereby caused damage to www.ciirulis.com, in such a case, www.ciirulis.com will use the right to demand compensation from the consumer in accordance with the procedures specified in the regulatory acts.
Therefore, www.ciirulis.com reserves the right to file a civil lawsuit against the consumer in court to recover the damages caused by www.ciirulis.com, including in cases where the product is not returned in its original packaging, the packaging of the product is significantly damaged, product seals are damaged, the protective film is torn (for example from the display of mobile phones), there are visible traces of careless use, for example, scratches and similar defects. In cases where it is possible to get acquainted with the product only by tearing or otherwise damaging the product’s original packaging (for example, film packaging for washing machines), the damage to the packaging is not considered a basis for bringing a civil claim against the Consumer. In this case, we ask Consumers to keep the packaging and return it together with the product, as the serial number of the product is indicated on the packaging.
In order to exercise the right of withdrawal as quickly as possible, please open the package as carefully as possible for this type of goods.
